ICE officer shoots a driver during a Bronx arrest attempt; two official accounts clash

The File desk · Oct 11, 2026, 11:10 AM UTC

Status

Disputed. The Department of Homeland Security and the New York attorney general both say an immigration officer shot a man in the Bronx on Thursday. They do not agree on what happened. No court record was found.

  • Partially confirmed

Both agencies say an Immigration and Customs Enforcement officer shot a man in a car in the Marble Hill section of the Bronx on Thursday, Oct. 8.

  • Disputed

Homeland Security says the man drove at officers. The attorney general's account centers on a child in the back seat. The two releases do not match, and neither is a court finding.

An Immigration and Customs Enforcement officer shot a man in his car in the Marble Hill section of the Bronx on Thursday afternoon, Oct. 8. The Department of Homeland Security says officers boxed in Oscar Bengal, a man it describes as a Dominican national living in the United States illegally with a robbery conviction, and that he rammed two government vehicles and drove toward officers. It says officers fired and a bullet or fragment grazed his neck, and that he was treated and taken to a detention center outside New York. New York Attorney General Letitia James said a 5-year-old was in the back seat. She called for a full and transparent investigation. It happened Thursday afternoon and is here on Sunday because the pages this desk checks did not carry it until Friday.

Homeland Security's account, all of it the department's claims: the shooting was at about 4:00 p.m. Eastern, during a targeted enforcement operation in the Bronx. It says Bengal was the target of an investigation by ICE Homeland Security Investigations into the shooting of a Customs and Border Protection officer. The release does not say which shooting. It says the New York Police Department had arrested him on Dec. 7, 2023. It says officers wore construction vests and masks that concealed their faces, that they fired because they believed their lives and the lives of other people were in danger, and that he was superficially struck in the neck. It says the FBI and Homeland Security Investigations are investigating. An official is quoted saying the government will continue to prosecute him. No charging document was found.

James's account is separate. She said that late Thursday afternoon an ICE officer shot a New Yorker in his car while a five-year-old child sat in the back seat. She called for a full and transparent investigation and said she has full faith in Bronx District Attorney Darcel Clark. The Homeland Security release, as far as this desk read, does not mention a child. This desk did not fetch a statement from the mayor, so that side is not here.

The two releases agree that an ICE officer shot a man in a car in that neighborhood. They do not agree on the rest. No body-camera video, no court record, and no finding on the officer's status were in the pages opened.
