A Plymouth jury sat about seven days and could not agree. On Friday, Sept. 4, Judge William Sullivan called a mistrial.

Lindsay Clancy is 36. She does not deny strangling her children — Cora, 5; Dawson, 3; and Callan, 8 months — at the house in Duxbury in January 2023.

Her lawyer, Kevin Reddington, said postpartum psychosis and insanity. Prosecutors said she knew what she was doing. They said she appreciated the wrongfulness of the killings.

Sullivan told the jury: “At this point, I'm going to declare that the jury is deadlocked and I'm going to declare a mistrial.” Jurors had sent several notes saying they were stuck.

That morning Reddington asked Sullivan to remove a holdout juror. Sullivan said no. Reddington went to the Massachusetts Supreme Judicial Court. The high court said no.

District Attorney Timothy Cruz has not said whether he will try the case again. “There will be no decisions made today,” he said. A hearing is set for Sept. 29.

Clancy, a former nurse, “remains in custody at a state hospital” and “is due in court for a follow-up hearing on September 29,” Reuters reported. The BBC wrote that she “will remain held on the same murder charges and continue to stay in the mental health facility in which she is currently housed.”
